Acceptance of Terms

By downloading, installing, or using the DDisk mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

DDisk ("we," "our," or "us") reserves the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.

Description of Service

DDisk is a mobile application that enables users to:

• Create and manage Arweave cryptocurrency wallets
• Send and receive AR tokens
• Upload files to the Arweave permanent storage network
• Encrypt and decrypt private files
• Purchase and use Turbo credits for file uploads

User Responsibilities

By using DDisk, you acknowledge and agree that:

• Wallet Security: You are solely responsible for maintaining the security of your wallet, including backup of your JWK file and any passwords. We cannot recover lost keys or passwords.
• Permanent Storage: Files uploaded to Arweave are permanent and cannot be deleted. You are responsible for what you upload.
• Legal Compliance: You will not use the App to upload illegal content or engage in any activity that violates applicable laws.
• Accurate Information: Any information you provide to us must be accurate and complete.

Prohibited Uses

You may not use DDisk to:

• Upload, store, or transmit any illegal, harmful, or objectionable content
• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Attempt to gain unauthorized access to any systems or networks
• Distribute malware, viruses, or other harmful software
• Engage in any activity that could damage, disable, or impair the App

Fees and Payments

DDisk offers both free and premium subscription tiers. By making a purchase:

• Subscriptions: Premium subscriptions are billed through the Apple App Store. Subscription management and refunds are handled according to Apple's policies.
• Turbo Credits: Turbo credit purchases are non-refundable once credits have been added to your account.
• Network Fees: Arweave network fees for file storage are separate from any DDisk fees and are subject to network conditions.

Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

• The App will be uninterrupted, secure, or error-free
• The Arweave network will always be available or functioning
• Files uploaded will be accessible indefinitely (this depends on the Arweave network)
• The value of AR tokens or Turbo credits will remain stable

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DDISK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of AR tokens or other cryptocurrency
• Loss of access to uploaded files
• Loss of private keys or passwords
• Unauthorized access to your wallet
• Any damages arising from network failures or third-party services

Intellectual Property

The App, including its design, features, and content, is owned by DDiskand protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Content you upload remains your property, subject to the licenses you grant by uploading to the Arweave network.

Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for any reason. Upon termination:

• Your right to use the App will immediately cease
• You remain responsible for any content you have uploaded to Arweave
• You should export your wallet data before uninstalling the App

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
